A versão resumida

Um resumo em linguagem simples. O texto completo abaixo é o que vale.

Use material you are allowed to use

Your own chats and notes, and other people’s messages only with permission or another lawful right. You are responsible for that choice.

Always be honest that it is AI

Never present a clone or its replies as the real person, and never use them as evidence of what someone said.

Respect living and deceased people

Honour objections, protect private details, leave their contacts alone and act with care for families.

No harm, ever

No harassment, fraud, deception, sexual exploitation, clones of living children or unlawful use.

Who this applies to

This policy applies to everyone who uses Memory Clone and forms part of our Terms of Service. It covers what you import, how you use clones and what you do with their replies.

Permission and lawful use of material

  • Import only material you have the right to use: your own messages and notes, and other people’s messages or personal information only with their permission or another lawful basis under the law that applies to you.
  • You alone make these decisions and are responsible for them. We do not check your permission or review what you import.
  • Before creating a clone of a living person other than yourself, obtain their permission. If they object, stop using and delete the clone.
  • For a clone of someone who has died, act with respect for them and for the privacy and feelings of their family and others in the conversations, and respect any wishes they expressed.
  • Minimise: import only the conversations you need and remove unrelated or highly sensitive information where you can.
  • Take particular care with material involving children or vulnerable people. Never create a clone that represents a living child (a person under 18).
  • A clone in memory of a child who has died may be created only by a parent, legal guardian or close family member, for private remembrance. It must never be shared publicly, used to contact anyone, or used to create sexual, degrading or exploitative content of any kind.
  • Do not import material obtained unlawfully, such as hacked accounts, intercepted messages or confidential information you are not entitled to use.

Honesty: no impersonation or deception

  • Do not present a clone, or anything it writes, as the real person, as their genuine words or as their current views.
  • Do not use a clone to contact, mislead or manipulate people who believe they are talking with the real person, including by copying replies into messaging apps, email or social media.
  • If you share any output, make clear that it was generated by AI.
  • Do not use clones to create fake evidence, testimonials, reviews, endorsements or records.
  • Do not use clone output as evidence of what a real person said, thought, intended or agreed, for example in legal, family, employment, insurance or administrative matters, or present it as a record of their words.

Prohibited uses

You must not use Memory Clone to create, request or facilitate:

  • harassment, bullying, threats, intimidation, stalking, doxxing or surveillance of any person;
  • contacting, pressuring, harassing, embarrassing or exposing the person a clone represents, their family or anyone who appears in the imported conversations, or revealing their private information;
  • fraud, scams, identity theft, social engineering or attempts to obtain money, credentials or access by pretending to be someone;
  • clones of public figures, celebrities, politicians or officials used to deceive, to suggest their endorsement or to exploit their name, likeness or identity commercially;
  • sexual content involving a real, identifiable person without their explicit consent, any sexual content involving minors, or non-consensual intimate imagery or text;
  • content that promotes violence, terrorism, self-harm or suicide, or that targets people for who they are (for example race, ethnicity, religion, disability, sex, sexual orientation or gender identity);
  • election or political disinformation, including impersonating public figures or officials;
  • decisions about people in employment, housing, credit, insurance, education, immigration or law enforcement;
  • medical, legal or financial advice presented as reliable, or anything that puts someone’s safety at risk;
  • infringement of intellectual property, privacy, confidentiality or publicity rights;
  • anything else that is unlawful where you or the affected people are.

Protecting the Service

  • Do not attempt to bypass credit charging, licence checks, rate limits, relationship boundaries or other safeguards.
  • Do not probe, scan or attack our systems, or interfere with other users. Responsible security research is welcome: report it to contact@memoryclone.com and give us reasonable time to fix issues before disclosure.
  • Do not use automated scripts, bots or scraping, or resell or share access to the Service.
  • Do not try to access or extract other users’ accounts, clones, credits or data, or our prompts, source code or model configuration, for example by prompt injection, probing our servers or exploiting bugs. If you find a bug, report it instead.
  • Do not use the Service or its output to develop, train, fine-tune or benchmark AI models, or to build a product that competes with Memory Clone.

Emotional safety

Talking with a clone of someone you love, especially someone who has died, can be comforting and also painful. Take breaks, keep real-world support close, and stop if it harms your wellbeing. A clone is not a therapist or crisis service. If you are in crisis or thinking about harming yourself, contact local emergency services or a helpline listed in the AI Transparency Notice.

Reporting misuse and clones made without permission

If you believe someone is misusing Memory Clone, including to clone you or a family member without permission, email contact@memoryclone.com with the subject “Clone report” and as much of the following as you can:

  • your name and how to contact you, and your relationship to the person concerned if you are reporting for someone else;
  • who you believe created the clone, their email address if you know it, and why you believe a clone exists;
  • what has happened, for example messages, screenshots or posts showing clone output being used, and what you would like us to do.

What we can do

  • acknowledge your report within 3 business days and review it;
  • ask the account holder to confirm their permission or lawful basis, or to stop using and delete the clone;
  • restrict, suspend or close the account responsible, which stops our cloud AI processing and paid features for that account;
  • preserve the records we hold and cooperate with the police, regulators and courts where the law requires or permits;
  • handle any data protection request you make about information we hold, as described in the Privacy Policy.

What we cannot do

  • Chats, clones and replies are stored on users’ own computers. We cannot see, retrieve or delete them, and we may be unable to identify a clone from the information given.
  • We will not normally tell you who created a clone or share their personal information, unless the law requires it or a court orders it.
  • We cannot resolve legal disputes between people. Your rights against the person who created a clone, for example under data protection or privacy law, are not affected.

Enforcement

We do not monitor how people use clones on their own computers, but we act on reports and on information we hold. If you break this policy we may warn you, limit features, remove credits or slots obtained through abuse, refuse future purchases, and suspend or close your account. We may also preserve and disclose records as described in the Suspension and termination section of our Terms.

Our response is proportionate to the seriousness of the breach and, where reasonable, we will tell you why and give you a chance to respond. We may act without warning where a breach is serious or unlawful or there is a risk of harm. Serious breaches, such as sexual content involving minors, may be reported to law enforcement without notice. If we close an account because of a serious breach, we do not refund unused periods or credits, except where the law requires.
